TrakBit — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the TrakBit mobile application ("App", "Service"), developed and operated by TrakBit ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of the Service

TrakBit is a habit-tracking application that helps users build, monitor, and maintain daily habits. The App offers tools including habit creation, streak tracking, progress statistics, reminders, and the ability to share progress with others.

1.1 Free Features

The following features are available to all users at no cost:

  • Create and track up to 2 habits.
  • Share habit progress as an image or text 1 time.
  • Full access to streak tracking, statistics, and completion history.
  • Customizable reminders and notifications.
  • Light and dark theme support.
  • Support for multiple languages (English, Spanish, French, German, Portuguese).

1.2 TrakBit Pro (Paid Subscription)

TrakBit Pro is an optional auto-renewable subscription that unlocks additional features:

  • Unlimited habit creation (no cap on the number of habits).
  • Unlimited sharing of habit progress.
  • Access to all current and future Pro features.

2. Subscriptions and Payments

2.1 Subscription Plans

TrakBit Pro is offered as an auto-renewable subscription with the following plan options:

  • Monthly Plan: Billed once per month.
  • Annual Plan: Billed once per year.

The exact prices for each plan are displayed on the purchase screen within the App before you confirm any transaction. Prices may vary by region and are determined by the applicable app store (Apple App Store or Google Play Store).

2.2 Free Trial

We may offer a free trial period for TrakBit Pro at our discretion. If a free trial is offered, you will not be charged until the trial period expires. At the end of the trial, your subscription will automatically renew at the standard price unless you cancel before the trial ends.

2.3 Auto-Renewal

Your TrakBit Pro subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your payment method on file with the applicable app store will be charged for renewal within 24 hours prior to the end of the current period.

2.4 Managing and Canceling Subscriptions

You can manage or cancel your subscription at any time through your device's subscription settings:

  • Apple (iOS): Settings > [Your Name] > Subscriptions > TrakBit Pro.
  • Google (Android): Google Play Store > Menu > Subscriptions > TrakBit Pro.

Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date. No refunds are provided for partial billing periods.

2.5 Price Changes

We reserve the right to change subscription prices. If a price change affects your active subscription, you will be notified in advance and given the opportunity to cancel before the new price takes effect, in accordance with the policies of the applicable app store.

3. Account and User Data

3.1 Account Creation

When you first use TrakBit, you create a local profile by providing your name. TrakBit does not require a traditional username/password account. Your data is stored locally on your device.

3.2 Data Collected

TrakBit collects and stores the following data locally on your device:

  • Profile information: Name and a system-generated user identifier.
  • Habit data: Habit names, descriptions, schedules, completion records, streaks, and progress statistics.
  • Preferences: Language, theme, notification settings, and default reminder times.

This data is stored exclusively on your device and is not transmitted to our servers.

3.3 Cloud Backup

TrakBit may offer optional cloud backup functionality via iCloud (iOS) or Google Drive (Android). If enabled, your habit data is stored in your personal cloud storage account. We do not have access to this data.

3.4 Analytics

TrakBit may use third-party analytics services (such as Mixpanel) to collect anonymized usage data that helps us improve the App. This data does not personally identify you. You can review what data is collected in our Privacy Policy.

4. Account Deletion

You may delete your account and all associated data at any time from within the App:

Profile > Account Settings > Delete account and data

This action will:

  • Permanently erase all locally stored data (habits, progress, preferences, and profile information).
  • Cancel all scheduled notifications.
  • Reset the App to its initial state.

This action is irreversible. Deleted data cannot be recovered. If you have an active TrakBit Pro subscription, deleting your account data does not automatically cancel your subscription. You must cancel your subscription separately through your device's subscription settings (see Section 2.4).

5. Intellectual Property

5.1 Ownership

All rights, title, and interest in and to the App, including but not limited to its design, code, graphics, icons, animations, text, and underlying technology, are owned by TrakBit or its licensors and are protected by applicable intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

5.3 Restrictions

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App for any unlawful purpose.
  • Attempt to gain unauthorized access to any systems or networks connected to the App.

6. User Conduct

You agree to use the App only for its intended purpose of personal habit tracking. You are responsible for all activity associated with your use of the App. You agree not to:

  • Use the App to store or transmit any content that is illegal, harmful, or violates the rights of others.
  • Interfere with or disrupt the integrity or performance of the App.
  • Attempt to circumvent any subscription or access restrictions.

7. Third-Party Services

The App integrates with the following third-party services:

  • Apple App Store / Google Play Store: For distribution and payment processing.
  • RevenueCat: For subscription management and entitlement verification.
  • Apple Push Notification Service / Firebase Cloud Messaging: For delivering habit reminders.
  • iCloud / Google Drive: For optional cloud backup (user-initiated).

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

8. Disclaimers

8.1 "As Is" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee of Results

TrakBit is a tool designed to help you track habits. We do not guarantee that using the App will produce any specific results, behavioral changes, or health outcomes. The App does not provide medical, psychological, or professional advice.

8.3 Data Loss

Since your data is stored locally on your device, we are not responsible for data loss resulting from device failure, App deletion, operating system updates, or any other cause. We strongly recommend using the cloud backup feature when available.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRAKBIT, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless TrakBit, its developers, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the App or your violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this document. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with any changes, you should stop using the App and delete it from your device.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is immediately revoked.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Panama, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Panama.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrakBit regarding your use of the App and supersede any prior agreements.

17. App Store Specific Terms

17.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and TrakBit, not Apple Inc. ("Apple").
  • Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • Apple is not responsible for any product warranties, whether express or implied by law.
  • Apple is not responsible for addressing any claims relating to the App or your use of the App.
  • Apple is a third-party beneficiary of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you.

17.2 Google Play Store

If you downloaded the App from the Google Play Store, you acknowledge that Google LLC's terms of service apply to your use of the Google Play Store. Payment processing for subscriptions is handled by Google Play.

By using TrakBit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
